The social perception of pardon in Brescia and Florence

Abstract

The law on the pardon, still before the definitive draft, has made to glimpse a notable interest from the public opinion, that him broken among who wanted to immediately proceed, who whit caution, appraising by chance case and who refused it beforehand.You thought, therefore, to be necessary to sound the thought of the community around the return in the same one of the released convict. The authors conducted research on the social perception of the pardon in the cities of Brescia and Florence, through the completion of 200 questionnaires around city and the comparison of the data. The questionnaire is anonymous (information requested does however include age, profession, qualifications and nationality), and is made up of seven questions aimed at understanding the level of knowledge that community has on the matter, their opinion of the action, what the reasons were for its promulgation, and what they believe the state of mind and future behaviour will be of the released prisoner. After comparing national and local number of prisoners in jails before and after the pardon, the authors examined other measures suggested by the Institutions, setting particular attention to the use of the alternative measures, less ghittoizing and considered favoring resocializing runs and the reparatoty justice, tool that looks at the needs of the victim, which, to them notice, appear to be the most functional to the rehabilitation and the consequent reintegration of the convict into society. Finally, the real effects of the provision have been examined, using itself of a detailed account of the pre and post pardon situation prisons, published by the Administration Penitentiary Department, which are results less “catastrophic” in comparison to the forecasts effected from the means of communication of mass and to the in relief social perception, that they took for granted the return shortterm, of the detainee released, in the penitentiary circuit.
