Law and procedure applied in the Italian identification and deportation centres

Abstract
The following assay will begin analyzing the legislative framework on administrative detention of irregular foreign nationals; then the existing practices will be considered, underlying how they doesn’t respect the established procedures, often violating fundamental rights such as the right to defense. It is easy to understand why rebellions, riots and acts of self-harm often occur, due also to the poor and unacceptable conditions of places of administrative detention. Then, we have to consider also the difficulties of working conditions of the police force. These reliefs require to closly consider the issue of fundamental rights of foreigns subjected to administrative detention, in order to identify the solutions to adopt for their greater effectiveness and protection.
