INFORMATION ON THE PROCESSING OF PERSONAL DATA (EU REGULATION 2016/679, hereinafter "Regulation")

Dear Customer,
in this document, we inform you of the characteristics of the processing of your personal data (by way of example and not exhaustively; name, surname, identity document and copy of the same, telephone, email address) carried out by Pensa MultiMedia s.r.l. (hereinafter the "Publishing House"). The data of the magazines present on the OJS platform of Pensa Multimeda s.r.l. (ojs.pensamultimedia.it) are also processed by the same, information is provided here on:

1) Who is the Data Controller?
The Data Controller of your personal data is Pensa MultiMedia s.r.l., with registered office in Via A.M. Caprioli, 8 - 73100 Lecce - Tel. 0832.230435.

3) On what legal bases and for what purposes does the publishing house process your data?
The processing of your personal data is carried out by the publishing house only in the presence of at least one of the following conditions:

  • fulfillment of legal obligations;
  • execution of the contract entered into by you with the publishing house and pre-contractual activities;
  • consent for specific purposes;
  • legitimate interest of the publishing house.

The treatment, therefore, is carried out in compliance with the conditions of lawfulness provided for by the Regulation and is limited to what is necessary for the publishing house and / or third parties to carry out activities connected and instrumental to:

  • execute the contract and pre-contractual measures, including the management of judicial and extra-judicial disputes and the authorizations to operate on relationships in the name of other subjects;
  • if you have expressed your consent, carry out activities aimed at the continuous improvement of the service offered, such as: detection of the degree of satisfaction with the quality of services rendered; the marketing of products and services; market studies and research; profiling activities to offer you personalized products and services that meet your needs;
  • pursue the legitimate interest of the publishing house in offering products and services that best meet the needs of customers. For this activity, the publishing house identifies the recipients of the commercial offer through non-invasive criteria (e.g. age, residence, etc.). The publishing house carries out a preliminary assessment of the impact of this activity on the rights, interests and freedoms of the recipients. In addition, the publishing house allows them not to further benefit from this service through the option to unsubscribe from the list on every contact occasion.

Within the limits of the specific purposes indicated above, the processing of your personal data is carried out through manual, IT and telematic tools. The publishing house adopts adequate organizational and technical measures to guarantee the security and confidentiality of your personal data.

4) Who can the data be communicated to?
The publishing house can communicate your data to third parties belonging to the following categories:

  • for execution of the contract of which you are a part and pre-contractual activities requested by you;
  • to carry out optional activities you consent marketing and market research companies.

5) Can the data be transferred to countries outside the European Union?
The publishing house does not transfer personal data to third countries; however, it reserves the right to use cloud services and in this case the service providers will be selected from among those who provide adequate guarantees, as required by Regulation 679/2016 / EC.

6) How long is the data kept?
The publishing house keeps the data in a form that allows the identification of the interested subjects for a period of time necessary to achieve the specific purposes of the treatment, in compliance with contractual and / or regulatory obligations.

7) What are your rights?
We inform you that, as a data subject, you can exercise specific data protection rights, listed in the following list:

  • right of access: right to obtain confirmation from the Data Controller that personal data is being processed and, in this case, to obtain access to personal data and detailed information regarding the origin, purposes, categories of processed data, recipients of communication and / or data transfer and more;
  • right of rectification: right to obtain from the Data Controller the correction of inaccurate personal data without undue delay, as well as the integration of incomplete personal data, also by providing an additional declaration;
  • right to erasure ("oblivion"): right to obtain from the Data Controller the erasure of personal data without undue delay in the event that: personal data are no longer necessary for the purposes of the processing; the consent on which the treatment is based is revoked and there is no other legal basis for the treatment; personal data have been unlawfully processed; personal data must be deleted to fulfill a legal obligation;
  • right to object to processing: right to object at any time to the processing of personal data which have a legitimate interest of the Data Controller and / or to processing for marketing purposes, including profiling. In case of opposition to the processing for marketing, personal data are no longer processed for these purposes;
  • right to limitation of treatment: right to obtain the limitation of treatment from the Data Controller, in cases where the accuracy of personal data is contested (for the period necessary for the Data Controller to verify the accuracy of such personal data), if the treatment is illicit and / or the interested party opposed the treatment;
  • right to data portability: right to receive personal data in a structured format, commonly used and readable by an automatic device and to transmit such data to another Data Controller, only for cases where the treatment is based on consent or on contract and only for data processed by electronic means;
  • right to lodge a complaint with a supervisory authority: without prejudice to any other administrative or judicial appeal, the interested party who believes that the processing that concerns him violates the Regulation has the right to lodge a complaint with the supervisory authority of the Member State in who resides or habitually works, or of the State in which the alleged violation occurred.

We also inform you that you have the right to revoke any consent given to specific optional activities at any time, without prejudice to the lawfulness of the processing carried out prior to the revocation.

The publishing house provides you with information relating to the action taken with regard to your request without undue delay and at the latest within one month of receiving it.

8) Why could the publishing house process particular categories of data?
The publishing house does not require you to provide your particular data (by way of example and not exhaustively; personal data that reveal racial or ethnic origin, political opinions, religious or philosophical beliefs, or union membership, data relating to health or sexual life or sexual orientation of the person). However, the publishing house can incidentally process them to perform your specific requests for services and operations (e.g. application of discounts and concessions). For this reason, pursuant to art. 9 of the Regulation, the Data Controller is obliged to request your specific consent to the processing of these data. The publishing house limits itself to treating this information exclusively to fulfill the legal obligations and / or to execute the contract.

9) How does marketing profiling work?
Profiling, aimed at personalizing the services and / or products we offer you, concerns the personal data that you provide us directly and / or indirectly, as well as those available in social networks. This treatment takes place within the limits in which you have given your optional consent. You have the right to object at any time to profiling to personalize the commercial offer. In the event of opposition, your personal data will no longer be processed for this purpose.

 

GLOSSARY

Guarantor Authority for the protection of personal data Independent administrative authority established by law n. 675 of 31 December 1996 responsible for supervising compliance with data protection legislation.

Personal data Pursuant to art. 4, paragraph 1, no. 1, is "any information concerning an identified or identifiable natural person (" interested "); the natural person who can be identified, directly or indirectly, with particular reference to an identifier such as the name, an identification number, location data, an online identifier or one or more characteristic elements of its physical, physiological, genetic, psychic, economic, cultural or social identity".

Particular data Personal data that reveal racial or ethnic origin, political opinions, religious or philosophical beliefs, or union membership, as well as processing genetic data, biometric data intended to uniquely identify a natural person, health-related data or the person's sexual life or sexual orientation.

Profiling Pursuant to art. 4, paragraph 1, no. 4 of the Regulation, it concerns "any form of automated processing of personal data consisting in the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning professional performance, the economic situation , the health, personal preferences, interests, reliability, behavior, location or movements of that natural person".

Regulation The EU Regulation 2016/679 of 27 April 2016, relating to the protection of individuals with regard to the processing of personal data, as well as to the free movement of such data and which repeals Directive 95/46/EC.

Data processor Pursuant to art. 4, paragraph 1, no. 8 of the Regulation, this is the "natural or legal person, public authority, service or other body that processes personal data on behalf of the data controller".

Data Protection Officer (DPO) or Data Protection Officer (DPO) Figure introduced by the Regulation, whose main tasks are to inform and provide advice to the Data Controller, Managers and Persons in charge of data protection; monitor compliance with the Regulations; provide opinions on the data protection impact assessment; cooperate with the supervisory authority.

Data Controller Pursuant to art. 4, paragraph 1, no. 7 of the Regulation, it concerns the "natural or legal person, the public authority, the service or other body which, individually or together with others, determines the purposes and means of the processing of personal data [...]".

Treatment of personal data According to the art. 4, paragraph 1, no. 2, it is "any operation or set of operations, carried out with or without the aid of automated processes and applied to personal data or sets of personal data, such as the collection, registration, organization, structuring, conservation , adaptation or modification, extraction, consultation, use, communication by transmission, diffusion or any other form of making available, comparison or interconnection, limitation, cancellation or destruction".
